1. Introduction
Welcome to Relativum. These Terms of Service ("Terms") govern your access to and use of Relativum's services, including our website (https://relativum.com), mobile applications, and any other software or services offered by Relativum in connection to any of the foregoing ("Services"). Relativum is doing business as (DBA) Relative Companies LLC, a Georgia, USA based company (www.relativecompanies.com).
Please read these Terms carefully, and contact us if you have any questions. By accessing or using our Services, you agree to be bound by these Terms and by our Privacy Policy.
2. Using Relativum
2.1 Who Can Use Relativum
You may use our Services only if you can form a binding contract with Relativum, and only in compliance with these Terms and all applicable laws. When you create your Relativum account, you must provide us with accurate and complete information. Any use or access by anyone under the age of 13 is prohibited.
2.2 Our Services
Relativum provides an insight CRM designed for users to upload user insights/feedback and to use AI for analytics. Users can purchase a subscription or use a free plan.
2.3 Feedback and Suggestions
Any feedback, comments, ideas, improvements or suggestions provided by you to Relativum with respect to the Services shall remain the sole and exclusive property of Relativum. Relativum shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or any compensation to you.
3. Data Ownership and Usage Rights
3.1 User-Uploaded Data
All data uploaded by users through the platform remains on the platform and is owned by the users. You retain all rights and ownership of your content. We do not claim any ownership rights to your content.
3.2 AI-Generated Insights
Any insights generated by our AI may be used by users for business decisions, documents, and the like, but are owned by Relativum. This generated content may not be used by users to train models or sell the data. We reserve the right to use this AI-generated content for training and improving our services.
3.3 License to Relativum
By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods now known or later developed.
4. User Data and Privacy
4.1 Personal Data
In order to use the Services, users will be required to provide certain personal data including name, email, customer insights/information/metadata, and payment information. We will ensure that this data is handled in accordance with our Privacy Policy, available at https://relativum.com/privacy.
4.2 Non-Personal Data
We may also collect non-personal data through web cookies. The purpose of this data collection is described in our Privacy Policy.
5. User Responsibilities
5.1 Account Security
You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. Relativum cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
5.2 Acceptable Use
You agree not to engage in any of the following prohibited activities: (i) copying, distributing, or disclosing any part of the Services in any medium, including without limitation by any automated or non-automated "scraping"; (ii) using any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the Services; (iii) transmitting spam, chain letters, or other unsolicited email; (iv) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Services; (v) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; (vi) uploading invalid data, viruses, worms, or other software agents through the Services; (vii) collecting or harvesting any personally identifiable information, including account names, from the Services; (viii) using the Services for any commercial solicitation purposes; (ix) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; (x) interfering with the proper working of the Services; (xi) accessing any content on the Services through any technology or means other than those provided or authorized by the Services; or (xii) bypassing the measures we may use to prevent or restrict access to the Services, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Services or the content therein.
6. Termination
We may terminate or suspend access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
7. Warranty and Disclaimer
Relativum has no special relationship with or fiduciary duty to you. You acknowledge that Relativum has no control over, and no duty to take any action regarding: which users gain access to the Services; what Content you access via the Services; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release Relativum from all liability for you having acquired or not acquired Content through the Services. The Services may contain, or direct you to websites containing, information that some people may find offensive or inappropriate. Relativum makes no representations concerning any content contained in or accessed through the Services, and Relativum will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Services. THE SERVICES AND CONTENT ARE PROVIDED "AS IS", "AS AVAILABLE" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED.
8. Limitation of Liability
IN NO EVENT SHALL Relativum, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.
